What is the best way
to buy a home?
Use a Realtor who represents only buyers. Only this
type of realtor can provide you with total and
undivided loyalty. This type of realtor is called an
“exclusive Buyers Agent.”

would I want to use an Exclusive Buyers Agent?
Its simple. If you’re a buyer, you have everything
to lose and nothing to gain if you don’t use an
Exclusive Buyers Agent. The real question here is,
why wouldn’t you? That is of course, unless you’re

Some agents say they
can represent both me and the seller. How can this
be?
You be the judge. If you were selling a home, would
you want to list it with an agent who represents the
Buyer? Of course you wouldn’t, not any more than you
would want to be put in a position of having to
divulge your personal finances to the agent
representing the seller. What buyers usually don’t
understand is that when an agent shows a buyer any
home listed with that agent’s firm, or that agent,
his or her firm is obligated to protect the interest
of the seller. You also must be careful never to
fall into a “dual agency” situation!

I get a “better deal” if I buy

NO! The listing agent owes their loyalty to the
seller and is obligated to get the HIGHEST PRICE for
the seller.

How much does it cost
to use an Exclusive Buyers Agent?
Nothing. As part of the unilateral offer of
compensation through the Multiple Listing Service,
the seller pays our fee. You will not need more
money at closing because the listing broker pays our
fees from the commission received from the seller.

Can a Buyer’s Agent
represent me if I buy a “For Sale By Owner”?
Yes. The Buyer Agent discloses to the seller that
they are representing the buyer and normally the
seller is receptive to paying the fee.

agent, and they said they could be a buyer’s agent.
Were they correct?
Sometimes! There are basically “4 types of agents”:
Exclusive Buyers Agents (the best if you are a
buyer), seller’s agents, designated seller or buyer
agents (dual agency office), and dual agents.
Unfortunately, you never know what kind of agent
you’re working with until you identify a home. If
that home is listed with the agent or the agents
company, you will be losing out on the FULL BENEFITS
of exclusive representation. They cannot fully
represent you or help you negotiate a lower
price.Sorry - it’s the law. Their fiduciary duty and
legal obligation is to the seller.

How do I know what
kind of agent I’m working with?
Most agents will be reluctant or vague as to what
type of agency or representation they are offering
until you identify a specific property. That’s
because most agents like to keep their options open
by representing you as a buyer, seller or worse yet,
both. Don’t fall into this trap! Only an EXCLUSIVE
Buyer’s Agent can fully protect your interest as a
buyer. You will never have to ask the type of agency
from an exclusive buyer’s agent. We will tell you!

Who is ultimately
responsible if something should go wrong during the
transaction?
Remember, every agent is working as an “extension of
their BROKER”. In fact, it is illegal for an agent
to act independent of their broker. If you
experience a problem and want someone to take your
side, and the seller is represented by the same
broker, than you have a problem. They can take no
action which is ADVERSE to either the buyer or the
seller. In other words, you would have given up your
rights by signing a “consent to dual agency form”.
